The U.S. Department of Homeland Security (DHS) has issued a final rule regarding public charge determinations. California Health and Human Services (Cal HHS) leaders are reviewing the federal government’s new rule and assessing its impacts on families and communities across the state.
The final “Public Charge” rule will take effect in mid-September. The federal notice states that means-tested public benefits received prior to the rule’s effective date will not be considered under the new rule. Previously, cash assistance for income support and long-term institutional care assistance were considered for public charge purposes and will continue to be considered. As the California Department of Health and Human Services continues our review of the federal guidance and the final rule, we will post information for Californians about what this rule means for them at CHHS.ca.gov.
We are concerned that the federal “Public Charge” rule will cause confusion and discourage eligible families from applying for essential services.
While the California Department of Health and Human Services and its agencies are reviewing the details, we recommend that California communities seek information from reliable sources. This may not apply to your situation, so be wary of scams. Consult with qualified immigration legal service providers if you have questions, and know that California has consistently opposed harmful federal policies—including previous public charge rules—and remains committed to building healthy, inclusive communities where all people can thrive.
